Sexual Harassment in the UK - Key Differences from Japan and Practical Insights
In the UK, legislation related to harassment is regularly reviewed, and the obligations placed on employers continue to evolve. In October 2024, the Worker Protection (Amendment of Equality Act 2010) Act 2023 came into effect, introducing a new legal duty requiring all employers to take reasonable steps to prevent sexual harassment of their employees. Furthermore, the Employment Rights Bill, expected to come into force in 2026, will expand these obligations to include the prevention of harassment by third parties (such as customers or business partners), thereby further broadening the scope of employer responsibilities.
Employer responses are shifting significantly from reactive measures to proactive efforts aimed at preventing harassment before it occurs. This development has considerable implications for corporate compliance frameworks and risk management strategies.
Given that the UK legal framework differs from that of Japan, it is increasingly important for Japanese companies with local entities and expatriates in the UK to fully understand the latest legal developments and implement effective measures accordingly.
